Who is suing you · Citibank, N.A.

Sued over a Citibank account? First check who the plaintiff is.

Citibank sues in its own name, as Citibank, N.A., on Citi cards and on cards with a store’s name, such as Costco and Macy’s. A bank that collects its own debt is generally outside the FDCPA. Citibank still has to prove the balance and the agreement that applied to you. It also sells charged-off accounts to debt buyers, who then sue in their own names.

First, who is suing

Two kinds of Citibank case.

  • Citibank, N.A. is the plaintiff

Citibank is suing on a card it issued.

This is an original creditor case. Citibank made the loan, so there is little chain of title to attack. The questions move to the balance, the agreement that applied to you, and the statute of limitations. Brian also asks whether your balance went into one of Citigroup’s card trusts.

    What Brian looks for

  • A debt buyer is the plaintiff

A debt buyer says it bought your Citibank account.

Citibank sells charged-off accounts in groups. Brian’s point is that a bill of sale names the group and does not name you. The buyer has to prove the sale included your account.

    One account’s route

One Citibank account’s route · as a California appeals court traced it

Citibank sold this account with many others. A buyer still has to prove yours was one of them.

A California appeals court traced this account in 2019. Citibank sold the charged-off account to Cavalry SPV I with many other delinquent accounts. Cavalry SPV I sued on it. Brian’s point is that a bill of sale names a group of accounts and does not name you. The buyer has to prove the sale included your account.

  1. Citibank

The original creditor. It charged off the account.

  2. Transfer: The sale a buyer has to prove

    Cavalry SPV I, LLC

Bought it with many other delinquent accounts. The plaintiff.

  • Cavalry Portfolio Services

Collected the account for Cavalry SPV I.

“Unlike with Debt Buyers, under the Fair Debt Collection Practices Act (FDCPA) Creditors like Citibank are not regulated as debt collectors so there are fewer options to defend these lawsuits.”

What he looks for in a Citibank file

  • The version of the agreement that applied to you. In the Michigan complaints Brian shows, Citibank says an agreement was delivered to you and attaches none.
  • The paragraph that says you failed to object to the billings. Brian reads it as aimed at the Fair Credit Billing Act. A dispute letter you sent at the time is a dated record that you objected.
  • The account stated claim. Depending on your state, Citibank can argue that you agreed to the balance by not objecting. Brian answers with a counter affidavit that disputes the balance.
  • The debt collector notice on a creditor’s complaint. Brian uses it to send Citibank a validation letter. He argues that Citibank is collecting as a debt collector.
  • Citigroup’s card trusts. Brian asks Citibank to show an assignment of your account to the trust and back. The bank’s answer, as Brian describes it, is that only the receivables went in, and they went back to Citibank.
  • A right-to-cure notice, depending on your state. The South Carolina complaints in Brian’s files say Citibank sent one. If you never got it, Brian says to deny it in your affidavit.

What people ask

Questions about Citibank.

If the account is years old, the timing questions are on the old debt page. If you have already been served, start here instead.

The Michigan complaints Brian shows attach none. They say an agreement was delivered to you and that, to the best of Citibank’s knowledge, you have it. The South Carolina complaints in his files attach the last account statement and no agreement. In one Washington case, Citibank produced an unsigned agreement in discovery. Brian’s view is that a form agreement is not yours. He says to ask for the version that applied to you. Depending on your state, the court rules may require the complaint to attach the agreement.

The Michigan complaints Brian shows say you failed to object to the accuracy of the billings sent to you. Brian reads that paragraph as aimed at the Fair Credit Billing Act. Under that law, you dispute a billing error in writing within 60 days of the first statement that showed it. The card issuer must acknowledge it within 30 days and resolve it within two billing cycles. Brian’s notes say those duties bind the card issuer, which is Citibank and not a later debt buyer. A dispute letter you sent at the time is a dated record that you objected.

It is paragraph 8 of the Michigan complaint. It makes an account stated claim. Brian’s notes give the Michigan rule: an account becomes stated when you agree to the sum, or when you do not object within a reasonable time. In his reading, a plaintiff uses the claim to avoid proving the terms of the written agreement. His answer is a counter affidavit that disputes the balance. The rule for an account stated depends on your state.

The Michigan and South Carolina complaints in Brian’s files carry a notice saying they come from a debt collector. In the one Washington complaint in Brian’s files, the notice names the plaintiff’s attorneys as the debt collectors. A bank that collects its own debt is generally outside the FDCPA. The FDCPA’s notice rule does not apply to a formal pleading. Brian still uses the notice. His notes say the law firm keeps it there to protect itself. He answers it with a validation letter to Citibank.

Citigroup’s annual report for 2015 said Citigroup moved card receivables into two trusts and kept servicing them. The same report said the trusts were consolidated, so the receivables stayed on Citigroup’s balance sheet. Brian argues that a trust can hold your balance. He asks Citibank to show an assignment of your account to the trust and back. In one Washington case, Citibank answered every securitization question by calling itself the original and current creditor. Brian’s reply in a forum thread says most of the court cases on this argument are negative.

Partly. Court records name Citibank as the original creditor in Cavalry and Velocity cases. Citibank bills of sale in Brian’s files show sales to other buyers. The buyer has to prove the sale included your account. This site has pages on seven debt buyers, Cavalry and Velocity among them. The hub lists all seven.

Before you file anything

About the motion to compel arbitration.

Check first whether your Citibank agreement has an arbitration clause. If it has one, Citibank wrote it. If Citibank sued you, Citibank chose court over arbitration. Brian says that in his own Citibank cases, Citibank asked for arbitration only after months in court. He says that in one case it asked just before trial. He argued that it had given up the right by then. Brian gives the same advice for a bank as for a debt buyer: “Arbitration is not your first move. Arbitration is your last resort.”
