Who is suing you · American Express National Bank
American Express is suing you. It still has to prove the balance.
American Express sues as American Express National Bank, a bank located in Utah. It is the original creditor. It sues in its own name, on personal cards and business cards. It still has to prove the contract, the breach and the amount. American Express Company’s annual report says it moves card receivables into trusts. Brian asks whether yours went there.

First, which card
Two kinds of American Express case.
A personal card
American Express is suing on a personal card.
This is an original creditor case. The questions are the agreement that applied to you, the balance and the statute of limitations. Brian also asks whether your receivable went into the American Express master trust. If it did, he asks whether any document brought it back.
A business card
American Express is suing on a business card.
Read the caption first. Brian’s question is who it names: you, the business, or both. He points to a U.S. Bank case where the question was an agreement with the member’s personal signature. If the caption names only your company, your state may require the company to answer through a lawyer.
The American Express master trust · the structure in American Express’s own SEC filings
American Express says it moves card receivables into trusts. Brian asks whether yours went there.
American Express’s annual report says it moves card receivables into trusts and does the servicing for them. The same report says American Express counts those receivables as its own assets. Brian asks for a document that shows your receivable stayed with the bank or came back to it. His own notes say courts have often rejected standing challenges built on securitization when the original creditor sues.
American Express National Bank, as issuer
Issues the cards. Sells the receivables from some card accounts.
Transfer: Receivables Purchase Agreement
American Express Receivables Financing Corporation III LLC
Buys the receivables. Moves them into the trust.
Transfer: Pooling and Servicing Agreement
American Express Credit Account Master Trust
Holds the receivables and issues securities to investors. The annual report calls it the Lending Trust.
Transfer: No document back in the complaint Brian audited
American Express National Bank, as plaintiff
Sues in its own name, on your account.
American Express Travel Related Services Company, Inc.
Named as the servicer in the Pooling and Servicing Agreement.
American Express Issuance Trust II
A second trust. The annual report calls it the Charge Trust.

“Most people read a complaint looking for what it says. I read it looking for what it refuses to say.”

“Courts have often rejected standing challenges built on securitization, especially where the plaintiff is the original creditor rather than a debt buyer.”

What he looks for in an American Express file
- The agreement that applied to you, with your signature. In the complaint Brian audited, American Express attached an unsigned form.
- A date of default, the date and amount of the last payment, and a breakdown into principal, interest and fees.
- A sworn statement from someone at the bank who knows the records. Nobody swore to anything in the complaint Brian audited.
- Whether your receivable went into the master trust, and any document that brought it back.
- On a business card, who the caption names, and an agreement with your personal signature.
- Whether Utah’s rules help you more than your own state’s, where the agreement names Utah law.

What people ask
Questions about American Express.
If the account is years old, the timing questions are on the old debt page. If you have already been served, start here instead.
Brian’s notes say it has to prove the contract, the breach and the amount. On ownership, he points to the American Express annual report. It says the company moves card receivables into trusts and does the servicing. Brian asks American Express to show whether your receivable stayed with the bank or came back to it. The same report says the company counts those receivables as its own assets. Brian’s notes say courts have often rejected standing challenges built on securitization when the original creditor sues. He sees the value in making American Express answer the question in writing.
Brian audited one in 2026. It was three pages long, with ten numbered paragraphs. It gave no date of default, no date or amount of the last payment, no breakdown into principal, interest and fees, and no term of the agreement it said the cardholder broke. The packet that came with it held an unsigned form agreement, one monthly statement and a military status report. Nobody from the bank swore to anything. Brian’s notes on the military status report: “They are not planning on a fight. They are planning on your silence.” He says he sees the same ten paragraphs in every American Express lawsuit that reaches his office.
The agreements in Brian’s American Express cases say Utah law and federal law govern, and that the bank holds the account in Utah. Brian’s point is that if American Express enforces the contract, it has to follow the contract too. He says he does not know whether Utah’s rules favor you over your own state’s. The answer depends on your state.
Read the caption first. It names the parties American Express is suing: the business, you, or both. That was Brian’s first question to a member sued on an American Express business account. In a U.S. Bank case Brian points to, the question was whether the bank could show an agreement with the member’s personal signature. If the caption names only your company, your state may require the company to answer through a lawyer. Either way, the deadline on the summons still runs.
Brian’s notes say complaints from American Express and Citibank often make that claim. Depending on your state, an account stated claim can rest on it. If you disputed a charge in writing, your letter and its proof of mailing show that you did object. Under the Fair Credit Billing Act, you dispute a billing error in writing within 60 days of the first statement that showed it.
Before you file anything
About the motion to compel arbitration.
Check first whether your agreement has an arbitration clause. The American Express agreement in one of Brian’s cases has one. Brian says arbitration costs you the rules of evidence, the court rules and the court’s protections. He leaves the choice to you. He gives the same advice for a bank as for a debt buyer: “Arbitration is not your first move. Arbitration is your last resort.”
