Partial Summary Judgement

ParkerGPT has been great at helping me with my strategy and helping me better understand the law and arguments.

One thing I have a question about is the motion to dismiss for failure to comply with consumer act. I already filed my answer and in my state it says that if you file a motion to dismiss after an answer and bring in outside evidence to your motion (which I will be with documents from the insufficient discovery response I got so far from the plaintiff) it will automatically be converted to a summary judgement.

to lower my risk of my dismissal being denied and the judge then granting a judgement against me. I discovered that I can scope this motion so it does not become a global summary judgement. I would like to verify that this would be correct to file a "MOTION TO DISMISS FOR FAILURE TO COMPLY WITH WISCONSIN CONSUMER ACT § 425.105 , OR IN THE ALTERNATIVE, MOTION FOR PARTIAL SUMMARY JUDGMENT"

This way the judge is only ruling on the WCA compliance not the lawsuit as a whole.

Is this correct am I missing something? I want to make sure I am limiting as much risk as possible.
