Has anyone used Midland's previous ASSURANCE OF VOLUNTARY COMPLIANCE/ASSURANCE OF DISCONTINUANCE against them. I am currently doing a counterclaim and added punitive damages to the list stating that Midland knew what they were doing was wrong and have been caught by multiple states including mine. granted some of this did sunset according to paragraph 71 but, it is to show the court that they are running recklessly. Here is the fully signed one that is publically available for Iowa. I have a public request into the one for my state with the AG office.

I also plan when I am done with this case to send a letter to the AG to alert them that they aren't following their agreement and let that big dog take care of them in my state.
I understand that I cannot enforce this but this is to pull in punitive damages to show evidence that they knew what they were doing and agreed not to with the AG. By not following this they knowingly caused me damage.

My immediate thinking is I don't sign anything unless I can prove it. We are the good guys. So, if you have the goods on the them and can meet the burden of proof to win your case, go get 'em.

Thanks. Yes, I have a reasonable case that does show how they created actual damages by filing this suit and violating several steps along the way. I am adding punitive damages because they have a documented history that they knew what they are doing is wrong and should have checked over my case more closely before continuing. I hope that the facts of my case will become something that the AG in my state could use to enforce penalties on them as they violated several of the points in the multistate AVC that did not sunset (see paragraph 71 of the AVC some did sunset). Again, I understand that the AG is the only one that can enforce this my argument is to show that they knowingly are violating my rights that caused me damage and that this is connected to my actual damages not the statutory damages.
