False claim from Plaintiffs counsel

Amohab ·

Does anyone know how to handle a lie told by plaintiffs counsel during a hearing ? The specific lie in question was that I was not willing or open to communicate with plaintiffs counsel to complete the joint trial stipulation as per courts order. Plaintiffs counsel never attempted to communicate to complete the filing. I corrected this during the hearing. The judge then ordered a meeting next week and in her order stated “defendant is willing to accept communication from plaintiffs”. I was thinking of filling a response to correct the record. But if anyone has suggestions?

Pick your battles. Make a record, maybe remind the court in your next proceedings about what they said (don't discuss settlement discussions in court-works both ways) and remain respectful so you don't look like a bad guy. Polite reminder respectfully. "Just don't fight it out in front of the Court as it just sees two people arguing rather than one guy being reasonable. Good luck.
