Entered Default Judgment

Fab · May 13, 2026

I need to file a motion to set aside judgment. the parkergpt just said to only file this. Should I file the answer and counterclaim along with the motionto set aside? Also, there are several templates on here for motions to set aside. Which one do I use?

The case is closed when there is a judgment in most states so you don't have a right to file an answer to a closed case. First got to get the judgment set aside and then it starts over along with your rights to answer. Check out the rules in your state. BPP

You are right. I wasn't clear in my question, I read that I needed to file a "proposed answer" attachment along with my declaration in the motion packet that I need to file. I am in California.
