Appeal vs MCM

Lost my trial vs MCM down here in Texas, but wish I would have prepared a bit more. Found this site a bit late so was not able to submit counter affidavit in time. I did submit my opening statement and specific exhibits (from the MCM paper dump) directly to the judge and read each to dispute their standing. First time in court and was not sure of proper etiquette to engage and raise questions to MCM atty, so was very calm and polite (maybe too much). Afterwards thinking I should have turned my "Brian" on. For instance, when I brought up general Affidavits in other states vs here in Texas, the MCM atty said Affidavits are Federally recognized and one could be made in Area 51 (yes she brought up the possible secret alien site) and Texas will recognize it. I didn't push back but later thought Brian would have said - well I'm not sure if that is correct from MCM atty Dana Scully but since she brought it up maybe that is where they keep the forward flow "Agreement"! ha

In my small rural County court, I later asked the Clerk if anyone contests these debt collectors and she said none that she recalls. Knowing this now I may have overwhelmed the judge with too many challenges as he was head down reading my exhibits as I spoke. From my exhibit, the MCM atty agreed to throw out the NY Tyler Burich Real Property Law. A small win that will call out in appeal.

Onward to Appeal - submitted doc's from ParkerGPT (LOVE IT!) under the 21 day window this week and all accepted. Included my formal submittal over inability to afford court costs and the bond, 2x the amount = $10K, and that was granted by the trial judge. A big win for my appeal, whew! Waiting for the Appeal court to respond but already have my Brief ready, thanks to ParkerGPT!

    Well it certainly is a learning process on the fly but GREATLY appreciate Brian and the team for this site!

    Received Notice on Sat and realized not going to a District court for appeal but a County Court for this small claims appeal. No problem here with ParkerGPT to run the new venue scenario with me. An immediate plus is that its still in my backyard vs heading in to the big city, and essentially a new trial. Submitting answer (only given 8-days down here) and counter-affidavit with all my supporting docs this week and will be ready by the July 29th hearing. Plan on heading that way to watch the proceedings to warm up plus ran My Cheat Sheets to prep.

    I was able to refocus all my efforts in 1 day thanks to this site. Certainly would not get that support from an atty over the weekend, else the cost would be out of this world for me.

    Here is my experience if it helps others on this Appeal:

    Love that the judge commented - 'Plaintiff did not prove case' and 'plaintiff takes nothing.' It was a bit stressful with a 1:30 schedule but he didn't walk in until 2. The Plaintiff 'coverage' atty didn't show but called Clerk that was on way so judge granted him time for us to wait - he said he would do that for me too so I didn't push. We didn't start until 3 but had all my documents (counter affidavit with colored tabs, note cards, cheat sheet doc, and other notes with pink tabs) and everyone in the court noticed my prep filled up my side of the table.

    Once started, Judge asked the coverage atty to begin. The fella didn't have anything other than asking for funds from prev case. Of course I had an opening statement, created with ParkerGPT from my Counter Affidavit. Judge was a fast talker and seemed rushed, so tried to emphasize my charge off zero balance and missing forward flow. He didn't let me finish my opening statement and asked Plaintiff for the "Agreement" doc. I was sure everyone saw me call out Agreement with air quotes, ha-ha. Of course he did not have it and I was sure to push the Bill of Sale cannot exist w/o it. Plaintiff tried to push w/o it today as they are still owed the debt, but from my Cheat Sheet pushed hard to explain to all in room - debt validity and ownership are separate and they have not proven ownership, of course my zero balance charge off as well. Judge asked Plaintiff what he wanted, so started thinking I lost and wasn't given time to bring up all my other actions and was ready to ask the judge if I could call out other challenges, but then he asked me what I wanted and agreed with me, WOW!

    After the judge left, the coverage atty said he was impressed by my Counter Affidavit and congratulated me. The whole time he was trying to scroll on his phone to read documents for responses to the judge, wasn't a good image. As I packed up, the Clerk, Bailiff, and Reporter asked how I lost the first case. Mentioned I wasn't prepared with supporting doc's and rushed as I didn't know about the process.

    Besides the stress, it was an interesting experience. Will be telling everyone I know in this situation. THANKS ParkerGPT!!!
