Just got out of court today for my first trial against LVNV Funding. The plaintiff's attorney was just a local attorney hired by the law firm representing LVNV to show up and collect default judgements. When the judge started by addressing a couple of my pre-trial motions, the attorney said he didn't have copies of any of them and so they must not have been sent. I pulled out my USPS Certified Mail receipts to provide him with the tracking number. He then asked for a brief recess so he could check his phone and make a call to the law firm.
After about 5 minutes, he came back in and just asked for a non-suit (basically asking for a voluntary dismissal with the option to re-file in the future). Not the best outcome, but certainly not the worst. I am happy to keep kicking the can down the road.
Make sure anytime you send something to opposing counsel, you send it USPS Certified Mail!
