The FCRA requires that you give them a bite of the apple first. So send your dispute letters to the company and the three credit reporting agencies to remove the false information and with documented proof of why the tradeline should be removed before suing. Make sure the letter you send (certified, return receipt requested and keep a signed copy of your dispute letter) has at the bottom a listing of the documents you send as the cra's are looking to avoid the work doing what you are requesting by blaming you for not supplying enough information. My letters on killdebt have everything you need. If the bad guy on your credit reported or pulled something on your credit AFTER the judgment in you favor date, that is a big time violation as they don't then have a "permissible or permissable" purpose or legal purpose really to be on your credit. So, you get them big time there so be patient as time is on your side for them to eventually screw up. They don't like to lose. Go get 'em. BPP
