Hope it helps. Just verify the law or any statute as always. Let us know.

The Court signed the motion but said it will decide at trial

Brian Parker Staff answered 1 week ago

Not sure what that means. Did the Court agree with you? What does the Order of the Court say? Thank you.

Me neither,

It says

Regarding:

A Motion to Dismiss was filed on 08/04/2025.

On 08/06/2025 the District Court of Maryland signed the motion, but took no action.

The motion will be considered on the date of trial.

Today, I learned that LVNV filed an opposition to the motion to dismiss, and the court denied my motion to dismiss. I feel that it was unfair that the court said they would consider the motion at trial and then denied the motion before trial after LVNV simply sent the same “evidence” they had initially filed. I do not know if I should file a motion to reconsider or just wait for trial. The ruling says I have a right to discovery under MD law. If When Resurgent sent me the first letter asking me to pay them on this, I sent a validation letter, and they sent a few statements back. I sent a second letter saying that there was not enough information to prove I owe you anything, and to stop contacting me. That is when they “sold” it to LVNV for them to sue me. I have the green return certified mail receipts.
