Here, Brian provides you with an excellent analysis of how to set aside defaults and default judgments and get back in the case. Whether it is based upon Federal or your State rules, it is all about timing. Remember TACF! This is an excellent video when you are defaulted through not fault of your own or if in some cases you may have ignored the lawsuit and got a default against you. If it is very early in the case, some states still allow you to set it aside because of the timing of the default-so don’t give up. Remember, TACF! Good luck.
