Watch How I Destroyed This Debt Buyer’s Case By Just Cross Examining One Witness
Includes Full-Length Instructional Video, Document Downloads, Key Points & Practical Strategies
Attorney Brian Parker demonstrates how to systematically dismantle a debt buyer’s case through strategic cross-examination of their custodian of records witness. In a Michigan circuit court trial against LVNV Funding, Parker used his E.A.R.S. method (Eyes, Ears, Repeat, Skewer) to expose the witness’s lack of personal knowledge and inability to authenticate documents from multiple entities in the chain of title. The case involved five different entities (SoFi Bank, SoFi Lending Corp., SoFi Personal Loan Trust 2023, Resurgent companies, and LVNV Funding), making it impossible for one departmental witness to have personal knowledge of all transactions.
Parker’s strategy focused on exploiting the business records exception to hearsay rules, demonstrating that the witness could only testify about her specific department’s records, not the entire chain of custody. By listening for key phrases like ‘maybe,’ ‘I don’t know,’ ‘assume,’ and ‘feelings,’ Parker systematically destroyed the foundation needed for document admission. The judge ultimately allowed documents in with significant caveats, recognizing the weakness of the testimony. This case illustrates the critical importance of understanding Federal Rule of Evidence 803(6) and its state equivalents when defending against debt buyer litigation.
