Velocity Investments Loses Big Collection Lawsuit Appeal

Here, Brian looks into how the Linchpin of the Collection Lawsuit is the same as Linchpin of any Appeal. When a case is appealed, the Court analyzes the case from a “De Novo” Analysis. This means that is steps back and looks at the case for the first time as though the lower court has yet to make a decision and looks at all the records and filings below with new eyes.
 
In the video, Brian points out how Velocity failed to show how it received the ownership of the debt without two missing assignments. The judge at the lower level pretended that the missing assignments did not exist because defendant had not entered the documents as evidence. But Plaintiff has the burden of proof. Yet, the Judge ruled as though Defendant had not provided enough “admissible” evidence.  Don’t ask…. The Circuit Court of Appeals saw the lack of assignments and ruled against the lower court and sent it back with instructions as to how it was to now look at the case.  Welcome to two years of my life proving what the lower court refused to look at no matter what I said or showed.  Don’t give up. Believe in your case.
