In 2018, I was involved in a motor vehicle accident in which I was not at fault. As a result, I required shoulder surgery in December 2019. From the beginning of the case through the final settlement, I was represented by legal counsel. All medical expenses were paid directly from the settlement proceeds by my attorney.
Despite this, Bon Secours St. Francis Hospital wrongfully sent the settled accounts to collections. First to Fox Collection and now to Capio Partners. I possess the settlement disbursement enclosures and photocopies of the checks issued to St. Francis that conclusively show "payment in full" of the accounts now being pursued. The case formally settled in 2021, and St. Francis received payment on April 12, 2021. They sent the account to collections on Dec 7, 2023.
Ever since, I have been subjected to 4 years of harassment for a debt that was fully satisfied. What remedies or legal actions are available to me in this situation? I want to put them throught the same inconvience and hell.
The amount that they claim I owe is only $1,107.20, but that doe not lessen the value of the harassment that they have subjected me to.
Also, just in June of 2023, Bon Secours St. Francis was hit with a 36.5 million fine for submitting false billing records - https://www.justice.gov/usao-sc/pr/st-francis-pay-united-states-365-million-settle-allegations-under-false-claims-act
