Hey Brian, I received a response from plaintiff (e Court) via email saying that Plaintiff filed an Adjournment? I\'m not sure what that even means as adjourning what? There is no notice even attached, yet only lawyers can log into the ecourt system. Can you shed some light on steps to take? This notice was in the email: Login to eCourts to view the Case Jacket. You will need a valid user ID (Bar ID) to view the submitted documents.Thank you.
Michele,
Im not a lawyer, but did ask a question in ChatGPT on this. Brian definately the one to confirm this is correct. Hope it helps.
Possible Reasons for the Adjournment:
1️⃣ Plaintiff Needs More Time to Gather Documents
If Midland Credit Management doesn’t have a proper chain of title or supporting evidence, they might adjourn to buy time to collect more paperwork.
This could indicate they are struggling to prove ownership of the debt.
2️⃣ They Are Delaying to Pressure You Into Settlement
Many debt buyers request adjournments to make you frustrated and more willing to settle.
They may hope that you lose track of deadlines or feel pressured to negotiate.
3️⃣ They Are Planning to Dismiss or Amend Their Complaint
Sometimes, a plaintiff adjourns a case before voluntarily dismissing it or modifying their claims because they know they don’t have a strong case.
If they plan to submit additional evidence or change their lawsuit, this could be their strategy.
4️⃣ A Court Hearing or Motion Was Scheduled and They Requested a Postponement
If there was a hearing date set, they might have asked the court to push it back.
This could be a delay tactic or simply due to their lawyer being unavailable.
Thank you so much for researching these, I’m very grateful. I was hasty in posting and actually did log into to the ecourt.. Apparently the court did set a trial date and plaintiffs then asked for a 90 day adjournment according to some statute. Now I need to learn what options do I have in the interim…wait or something else. Hopefully Brian will have a video on what we do when plaintiff responds (different variables we can take).
