should and when do I put a counter claim in MA? Im in a discovery phase in the court in Massachussets, Midland claims that the original contract "Me appliying for a CC" is not in their pocession.

Generally States allow you to create counterclaims when you file your answer. Beyond a certain amount of time, you have to file a motion for permission to file it. Check your court rules. “Litigate how you want to within the rules and don’t listen to the debt buyer” is what I tell my clients.
