Thank you Parker!! I'm beside myself right now. Just came back from court today and I didn't even get to plead my case. The Judge was very interesting in that he gave an hour speech to all of us lettung us know he reads each and every case that comes in and kept stating that this court honors the NJ Rules of Evidence and that we better be able to cite the Hearsay Rule 801. I'm sitting there nervous as heck and flabbergasted as both Rules are literally in my Counter Affidavit (Thank you Parker)! The Judge is also big on settling as he gave us all 10 min to negotiate settlements with the plaintiffs attorney. He then said if we decide to trial we could have a judgement aganist us for 20 years...WHAT! Well I plowed through, held my ground and spouted the rule of evidence and that the debt collector hasn't met their burden of proof to plaintiffs attorney during our 10 min outside negotiating. Plaintiffs attorney showed me the bills of sales and says, it's here, all these transfers and we have your cc statements. Yeah, no that doesn't prove anything I said. I would need the purchase and sale agreement here as per the NJ Evidence Rule 106. Well, I didn't settle, went back in to face the music with my Trial notebook, copies and sticky notes. Judge warned me of all the possibiities. Asked me if I understood, I said yes then I said I do have my opening statement Your Honor. He quickly turned to the plaintiffs attorney and the attorney blurted out for an ADJOURNMENT? The judge asked does he have a witness (I'm confused at this point). Plaintiffs attorney says they do not, but needs time to get their witness and the judge quickly said CASE Dismissed with Prejudice, you adjourned for 90, I gave you 60 for discovery and all that time you have no witness. I didn't know what hit me, but I knew what Case Dismissed w/o Prejudice meant. So, although my argument was never heard and I probably didn't win on anything, I'm just so grateful the case is dismissed. Thank you Parker, you are truly a blessing to us all who are fighting for our rights w/o lawyers! I'm grateful for all the golden nuggets you provide.
