Check the Court Rules. How many days are you allowed to Respond to a MTD? For example, in Michigan, you get 21 days to respond to a Motion to Dismiss (21days to the date of hearing from the date of receipt). If you get 21 days where you are and they sent it to you and you received it within less than 21 days, immediately notify them and the court of this and the rule they broke. Check your state rules on Motions to Dismiss and time to respond. Check their Proof of Service of they date they sent to you and the Court Docket on the timing of when they filed with the court towards that end. Generally, if you call the attorney and ask for more time because of their failure to follow the notice rules, they will move the hearing date.
