FDCPA Letters

Lio asked 6 days ago

I received a summons and complaint with NO affidavit or documents attached. I have never been contacted regarding the debt, so I'm conisdering this an "initial communication." While I'm working on my answer and affidavit (and possible counterclaim, I also plan on sending an FDCPA Violation Demand Letter to ARI.

I couldn't find an exact example letters on the "Forms and Document Downloads" section, though I found a "Creditor Validation Letter & Cease and Desist." Upon my inquiry on the subject, ParkerGPT/KillDebt.ai generated a "FDCPA VIOLATION DEMAND LETTER," which appears much stronger than the "Creditor Validation Letter & Cease and Desist" letter. It cites their violations, then demands their supporting documentation (within 30 days) and to cease and desist, complete with a section for each violation and a demand for immediate action. Even includes a section on securitization. I went back and forth for a while with follow up questions, and I now have a near-final draft (attached).

Ultimately, I'm wonding if sending this letter will strengthen my defense, or if I should save it for my answer, affidavit, and possible counterclaim.

Thanks for your direction and advice.

P.S. Brian - thanks for your work. I was SO worried for the first day or two, until I discovered your "Law and Lawyering" YouTube channel. I decided to pull the trigger on this membership last night. Great resources, and KillDebt.ai is a game changer. Feeling more and more educated and prepared every day. As you've said, "action is the cure to worry."
