Hey Brian and community.
I've been trying to get something off my credit reports for some time now (over 18 months). It's a JDB (the newest in a string) and the name of the company is OLIPHANT LLC. I've tried disputing them with the bureaus and even the address they have listed in the bureaus is wrong for sending letters and disputes. I do everything the 'Parker Problem' way dealing with these DC's and have had undeliverable as addressed sent back on my signature card.
I finally got a letter accepted by Oliphant after finding another address for them. The letter I sent was Brian's (Validation with Cease and Desist) that also mentions Permissible Purpose. This was over 2 months ago and there has been no response (not surprised). This particular debt is a Webbank deal that is full of securitization all over the place so I'm sure there are holes in their ownership documents proof.
What I'm wondering now is what would be my next step? Since the bureaus won't remove it even when I show the signed green card and that the creditor/DC is not providing information in the time required by law, what is the next step here?
Is this something that we could test with your new AI system or is there another letter/approach I should take? Do I need to start mounting an FCRA or FDCPA case and if so do I need to start looking for an attorney locally in Las Vegas Nevada to help me with the defense?
Let me know if I need to show you what the letter looks like that I did, and was curious to see if anyone here, including Mr. Brian Parker has any experience dealing with OLIPHANT.
Regards,
Casey Jones
The AI is just another way of creating the document you need, not a differant way to validate or seek something. It does all the work you are doing now. If something is on your credit report that is false and you have done your due diligence and disputes, you can sue them under the FDCPA and FCRA.
Ok Brian. That makes sense. Would it make sense to send an intent to sue letter to all 3 bureaus and the JDB or start the case and drop the hammer? Thank you by the way for the super fast response. Happy Friday to ya and I hope you all have a restful and enjoyable weekend.
