We handled the case administratively. We ordered a motion to dismiss with prejudice with supporting correspondence. This was the Judge's Order on 4/23/2025 DEFT'S MOTION TO DISMISS IS OVERRULED BY JUDGE GWIN on 04/25/2025 OTHER TERMINATION
What does OTHER TERMINATION mean? The plaintiff's keep submitting more documents to the case even tho it is terminated?
Most recently the following were put on the docket:
06/13/2025 NOTIFICATION OF NOTICE OF MERGER BY PLAINTIFF (Discover's merger with Capital one)
06/24/2025 MOTION FOR / TO MOTION TO DEEM SERVICE PERFECTED W/TEND ENTRY
Other important factors: this has been on the docket for 3 years. They have never had service of process because they keep sending mail to the wrong address. We came forward because we saw it on the docket and as I stated earlier, we handled it administratively.Any input is appreciated
I am not sure either. I can't advise you legally and don't know Ohio law. I have the video on Discover being bought by Cap One from last week. Weltman are hard to deal with. Don't do anything without advising that you do not accept service if you have not made an appearance but you might have accepted service with your current motion if you did not tell anyone you are not waiving service. Judge will supply you with why he ruled how he did usually. But again, if the Motion to Dismiss was based upon lack of jurisdiction (I don't know this), court possibly just told you that you are in now and you have to answer.
I would simply contact the court clerk (not judge clerk) for explanation. While keeping an eye on the docket, I (this is me only) would do nothing if I believe the case is terminated. Why poke the bear or wake the dog. The longer it goes on and I see the docket is not being added to, I leave it alone unless the case is still open or dates are need to be addressed.
